Terms and Conditions

These Terms & Conditions (“Agreement”) govern your engagement with Stu Creatives (“we,” “us,” or “our”) for branding, marketing, and creative services.

We offer packages and custom solutions that include, but are not limited to:

Branding & Identity

Copywriting & Messaging

Website Design & Development

Campaign Strategy & Content Creation

Ongoing Marketing Support

Creative Direction

Service details, deliverables, and timelines will be defined in a separate proposal or contract

Client Responsibilities

To ensure the success of each project, clients agree to:

Provide all necessary materials, access, and information in a timely manner

Respond to communications and feedback requests within 2–3 business days

Approve work or request changes within the agreed number of revision rounds

Delays in feedback or deliverables may impact timelines and may incur additional charges

Revisions

Each service package includes a set number of revision rounds, as outlined in your proposal. Additional revisions beyond that scope will be billed at an hourly or project-based rate

Payment Terms

A non-refundable deposit is required to begin work

Remaining payments are due per the milestones or final delivery date stated in your contract

Late payments may result in project delays, paused services, or late fees

All deliverables remain the property of Stu Creatives LLC until full payment is received

Intellectual Property

Once the project is paid in full, ownership of final approved deliverables (such as logos, graphics, and copy) transfers to the client. Stu Creatives retains the right to showcase work in our portfolio and promotional materials unless otherwise agreed in writing.

Confidentiality

We respect the confidentiality of all client information. Any proprietary materials shared with us will not be disclosed or used outside of the project without written consent.

Results Disclaimer

Marketing results may vary. While we aim to achieve measurable success, we cannot guarantee specific results such as increased revenue, followers, or engagement metrics.

Cancellations & Refunds

Projects canceled by the client after work has begun are non-refundable.

If a client becomes unresponsive for 14+ days, the project may be considered abandoned.

Canceled projects may be subject to payment for work completed to date.

Use of Third-Party Tools

Stu Creatives may use third-party tools, platforms, or contractors to deliver parts of your project. We are not liable for the terms, policies, or service disruptions of these third parties.

Limitation of Liability

To the fullest extent permitted by law, Stu Creatives shall not be liable for any indirect, incidental, or consequential damages related to services provided.

Governing Law

These terms are governed by the laws of the State of Georgia. Any disputes will be handled in the courts of Atlanta, Georgia.

Usage & Ownership

All materials, including presentations, PDFs, images, designs, copy, and other creative assets provided by Stu Creatives LLC (“the Company”) are the sole property of the Company and are protected under U.S. copyright law and other applicable intellectual property laws.

Permitted Use:

Materials are provided solely for client review, portfolio display, or evaluation purposes.
Clients may reference or discuss materials with the Company but may not reproduce, distribute, or modify them in any way without explicit written permission.

Prohibited Use:

Duplication, copying, or redistribution of any content for personal, commercial, or third-party purposes is strictly prohibited.
Modification, adaptation, or creation of derivative works from the materials is not allowed.
Unauthorized use may result in legal action, including but not limited to injunctions, damages, and attorney fees.

Ownership:

All creative work remains the intellectual property of Stu Creatives LLC.

Confidentiality:

All shared materials are confidential and proprietary. Unauthorized sharing, use, or publication constitutes a violation of these terms.
